On a proposal by the minister elected to handle the issues under the jurisdiction of the Ministry of Trade and Industry, the following shall be enacted under Article 4 of the Act on the Finnish Competition Authority issued on 29 July 1988 (711/1988):
Tasks of the Finnish Competition Authority
Article 1

In accordance with its task prescribed under Article 1 of the Act on the Finnish Competition Authority (711/1988), the Finnish Competition Authority shall:
(1) examine competition restrictions and take measures to eliminate them or their harmful effects;
(2) investigate the concentration cases falling under its jurisdiction;
(3) solve the exemption and negative clearance applications lodged with the office;
(4) supervise compliance with the decisions made under the Act on Competition Restrictions (480/1992);
(5) monitor and investigate competitive conditions;
(6) follow the preparation of economic legislation and give statements about questions related to its field;
(7) take initiatives to promote competition and to dismantle restrictive rules and regulations;
(8) may make a notification referred to in Article 9 and a request referred to in Article 22, paragraph 3, of Council Regulation No 4064/89 on the control of concentrations between undertakings;
(9) look after issues falling under its jurisdiction as a competent national authority under the EC legislation and engage in international co-operation in its field;
(10) produce publications and other relevant information pertaining to its field; and
(11) tend to other tasks prescribed or ordained to it.
Role of the Provincial State Office
Article 2
The State Provincial Offices shall operate under the guidance of the Finnish Competition Authority in issues involving the protection of sound economic competition.
Organisation of the Finnish Competition Authority
Article 3
(1) The head of the Finnish Competition Authority shall be the Director General. He or she shall be responsible for the economic, efficient and successful execution of the duties prescribed to the Authority.
(2) Two directors shall assist the Director General. The Finnish Competition Authority shall also contain other personnel in a civil service or employment-contract relationship.

The relevant Ministry shall order deputies to the Director General.
Article 5
The internal organisation of the Finnish Competition Authority shall, where needed, be determined in separate office regulations.
Procedure
Article 6
(1) The issues falling under the jurisdiction of the Finnish Competition Authority shall be decided by the Director General or, under office regulations, by another civil servant of the office.
(2) The Director General may also decide an individual issue, which would otherwise be decided by another civil servant.
(3) The issues shall be decided on the basis of presentation, unless office regulations provide otherwise.
Article 7
More detailed provisions on procedure and the other operations of the office shall be issued, where needed, in office regulations, which are confirmed by the Director General.
Qualifications
Article 8
(1) The Director General shall have a Master's degree in an appropriate subject, and experience within the field of the Office, business economics and leadership duties.
(2) The directors shall have a Master's degree in an appropriate subject and experience within the field of the office. One director shall, however, hold the degree of a Master of Laws.
Filling Posts and Recruiting Personnel
Article 9

(1) The Director General shall be appointed by the Council of State.
(2) The rest of the personnel shall be appointed or employed by the Finnish Competition Authority.

Article 12
The Finnish Competition Authority shall submit to the Ministry of Trade and Industry an annual report each calendar year. This shall be delivered no later than the month of March following the year in question.
Entry into Force
Article 13
(1)This Decree shall enter into force from 1 February 1993.
(2)This Decree shall repeal the Decree on the Finnish Competition Authority issued on 29 July 1988 (712/1988) and its subsequent amendments.
(3) Prior to the Decree becoming effective, measures required for its implementation may be taken.
